Stringent Implementation Cyber Laws in India - The Need of the Hour

Cyber laws deal with cyber crime viz. the relationship of internet  with electronic and technological elements like computers, hardware, software and related information's systems. The law is devised to control and stop cyber crimes like online frauds and scams, hacking, computer system attacks, identity thefts, prohibited or illegal content. Cyber crime can not only cause financial issues but also upset victims extremely on a mental level. There are two types of cyber crimes one is with computer as a target and the other using computer as a weapon. Cyber laws includes copyright, defamation, Freedom of Speech as well as harassment and stalking, contracts and employments, trade secrets and more.
Here are few examples of cyber crimes in India. 
For example google and other online search engines spend a great deal of time developing algorithms for search results. They also spend a lot of time and resource on developing maps, intelligent assistance and more. Cyber laws help these companies protect their trade secrets and take legal action with the help of cyber lawyers against cyber crime.

Online eCommerce scams are not new. There are many cases coming to light where people ask for transferring an amount of money against the transfer fee for  winning a big lottery amount. Many people fall prey to the high lottery prizes and transfer. Once the money is transferred by the victim, they receive nothing. Now, you can take help of the cyber law to trace such frauds. In 2012 a 32 year old man was arrested by the Cyber cell for duping a student from Kandivili for Rs 1.2 lacs through a lottery scam. The Mumbai cyber cell cracked this scam.

There have been many instances popping out in the media about leakage of personal Aadhar card details and more. It’s not that India does not have any cyber law. The law is very much there and comes under the Information technology Act, 2000 or IT act as they call it. Though internet has brought forth a lot of complex legal issues while the existing laws could be old school. The notorious cyber hackers hence try to tweak these laws taking disadvantage of the glitches and use it to their own benefit.  Even today with millions of Internet users in India, don’t have an email ID that is considered to be a legal email ID. There is not legalisation done for email IDS even today as there is no law to do so. As the times are changing rapidly and the country is digitisation, enabling of a legal support substructure to fit the current times is absolutely necessary.

The rate at which Cyber-crimes are increasing in India, it is high time that stringent cyber laws are brought into effect to control the further rise and even the existing rate of Cyber-crimes like online frauds, scams, hacks and more.

Fight Against Bulling – Know Your Rights

Though, one of the dictionary words for bullying is to cause someone to do something by making threats or insults or by using force. It actually means systematically and chronically inflicting psychological distress or physical damage. Bullying in schools and colleges has over the past few years increased and has resulted in depressions, lonliness, distress and even suicides. Ragging in colleges is also a kind of bullying done for fun but has also been a reason behind many student suicides.

In colleges bullying includes Physical abuse, psychological and emotional.


Physical – Abuse that results in physical fights and injuries due to the same

Psychological – Abuse that results in damage to human soul, spirit or psyche

Emotional – Abuse that is more of an accusation and cause emotional distress like use of abusive language, name calling, negative comments about looks and more.

There are some indirect kinds which include spreading rumors, threaten someone through someone and more. These days cyber bullying is also becoming one of the common vehicles of bullying people.

Laws & Regulations

The role of the college, school or educational institutions is of vital importance. Though at school level there are no such laws against bullying but its high time that such laws are brought in practice. As far as colleges are concerned, ragging in colleges is punishable act and many colleges in India follow stringent rules and regulations against it. The punishments could even lead to expelling the student from the college in addition to punishment by law.

UGC – The university grants commission or UGC has passed necessary regulations in order to control and eradicate the menace of ragging from colleges and universities. Some of these include that the institution needs to take necessary measures for anti-ragging. Forming an ant-ragging committee to ensure compliance with the regulations and laws against ragging. On receiving information about any incident relating to college, it is the duty of the head of the institution to report it immediately to file a FIR immediately. Any student who is a victim of ragging can also file an FIR at the nearest police station.

IPC – In the present times, even the Indian judiciary has made it mandatory today to furnish affidavit along with the application form that the student would not participate in ragging activities and if he/she does so, would be liable for punishment by the law.

AICTE – The All India Council of Technical Education has anti ragging laws for technical institutions, universities and deemed to be universities imparting technical education in place under section 23 and Section 10 of AICTE act, 1987.

MCI – The medical council of India has also made a regulation under prevention and prohibition of ragging in medical colleges/institutions under section its 1956 Medical Council Act.

Besides, due to the menace some notorious students are causing in the cyber space, the judicial law has also made certain laws to prevent and control such harmful activities.


Though the legislation differs from state to state, it is considered to be an effective move against bullying/ ragging. So, be alert and aware and if you happen to face any kind of bullying, go ahead and take immediate steps to punish the culprits.

SAARC MOOTING COMPETITION & LAW STUDENTS CONFERENCE 2016 INDIA ROUND | 9 -10 January 2016

Llyod Law College and MILAT (Menon Institute of Legal Advocacy, Trivandrum) are jointly organizing the first Prof. N R Madhava Menon Saarc Mooting Competition and Law Students Conference - 2016.  The main objective behind the competition is grooming the advocacy skills of SAARC students. The competition comprises of two rounds. The first round, better known as the Indian Round is scheduled to take place in India on January 9 and 10, 2016 at Lloyd Law College, Greater Noida. Next is the SAARC round, for India, Pakistan, Bangladesh, Bhutan, Nepal, Maldives, Afghanistan and     Sri Lanka scheduled on March 4-5, 2016, again at Lloyd Law College, Greater Noida. The top 5 teams from Indian round would qualify for the SAARC round.

As there are participants coming down from the SAARC countries, a conference for law students is also going to be organized for them, in order to create a platform for interaction on excellence in legal education and professional growth in South Asian region. 



Teams and Eligibility Criteria  
  1. There would be a researcher and two counsels in every team for the Indian Round
  2. The participant has to be born after January 1, 1986
  3. The participant has to be a bonafide student of undergraduate law degree as on                January 9. 2016
  4. The participant should not have practiced law in any jurisdiction
  5. Only one team per college is eligible for participation
  6. More than 3 participants per team are not permissible

Registration 
  1. The fees for registration to the Indian round is Rs 2500 /- only
  2. The payments for the same can be done through e-transfer followed by confirmation mail with transaction details or by Demand Draft followed by soft copy mail and duly filled registration form to profmenonmooting@lloydedu.in by 11.15 pm, December 15, 2015
  3. The Demand Draft has to be drawn in favor of LLOYD LAW COLLEGE, GREATER NOIDA and shall be payable at Greater Noida
  4. The Demand draft has to be posted or deposited with the Organizing Committee, Lloyd Law College, Plot No 11, Knowledge Park-II, Greater Noida - 201306, Delhi/NCR.
